Landlord didn't return your deposit within 14 days of move-out, or didn't itemize deductions? You can demand the full deposit + up to 2× damages.
The law (NY GOL §7-108): Within 14 days of vacating, the landlord must return the deposit AND provide an itemized statement of deductions.
Failure to comply entitles the tenant to the full deposit + additional damages up to 2× the deposit (so up to 3× total).
Deposit cap is one month's rent. Ordinary wear-and-tear cannot be deducted.
What to do with the letter
Mail it certified, return-receipt requested, to the landlord's address on file.
Wait 14 days. If no compliance, file a small claims case at your local NY Justice Court (Vestal: Vestal Town Court). Small claims cap outside NYC is $5,000 — plenty for any typical deposit dispute.
Bring the letter, your lease, the deposit-paid receipt, and any move-out photos to your hearing.
